Welcome to Trade Page Pty Ltd, ABN 98 682 127 126 (referred to as "Trade Page," "we," "our," and/or "us"). The information on Trade Page - Advertising for Businesses in Australia (the "website": http://www.tradepage.com.au) has been provided for your convenience. These Terms and Conditions ("Terms") govern your use of our website and the services provided by us. By accessing or using our website and services, you accept and agree to comply with and be bound by these Terms, as well as all applicable laws and regulations. If you do not agree to these Terms, please do not use our website or services.

Acceptance of Terms

By using our website or services, you agree to comply with the terms, conditions, privacy policy, notifications, and disclaimers provided on this website. If you are using our services on behalf of a business or other legal entity, you represent and warrant that you have the authority to bind that entity to these terms.

Services Provided

Trade Page is an online advertising platform that creates landing pages for businesses in Australia. We optimise each business page to focus on a specific trade service within a defined geographic location. These pages are designed to help businesses promote their services, connect with customers and generate leads in their selected geographic areas.

  • When you create a business page with us, you’ll have the opportunity to select one trade service per location deal. This service will be the primary trade focus of your business page, linked to your selected location’s, and optimised for search engine visibility.

    If you wish to optimise for additional services or target multiple locations, you can purchase additional trade pages. Each additional page will be fully optimised for its respective service or location, tailored to attract the right audience.
     

  • Optimised Keywords: The trade service you choose will be optimised with specific keywords that reflect your business and expertise. For example, a builder may select "bathroom renovations" or "remedial work" as their primary service. This allows us to tailor your page content which will aim to attract the right audience.
     

  • Location-Based Optimisation: We optimise your selected trade service for a specific location (e.g., suburb, city, and region). This ensures that your business page appears to local customers who are searching for that service in your area.
     

  • Exclusive Representation: Trade Page does not duplicate the same primary keyword across different businesses within the same location. This means only one business can be featured for a particular primary trade service in a specific area. However, due to how Google’s search algorithms work, there may be cases where multiple businesses from the same location appear in the same search results for a given keyword. While we aim to avoid keyword duplication, search results can sometimes reflect the competition based on broader search criteria.
     

  • Flexibility in Service Selection: If you wish to change or update the trade service your page is focused on, please contact us. We can assist you with adjusting your page to reflect a different trade service, subject to availability and location restrictions. Please note that a fee may apply for any changes made to your trade service, depending on the nature of the adjustment and availability in the selected location.
    The fee for this service will be communicated to you prior to making any changes, and you agree to pay the applicable fee before we proceed with any updates.

     

User Responsibilities
 

By using our website and services, you agree to the following responsibilities:
 

  • Accuracy of Information: You must provide accurate, current, and complete information when creating your business page or communicating with us.

  • Account Security: If you create an account and become a member, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • Prohibited Activities: You agree not to engage in any activity that is illegal, fraudulent, or harmful to our platform, including:

    • Posting false, misleading, or defamatory information.

    • Uploading malicious software, viruses, or harmful code.

    • Engaging in spamming, phishing, or other unwanted communications.

    • Violating intellectual property rights, including copyright and trademark infringement.
       

Disclaimer of Liability
 

  • No Liability for Services Provided: Trade Page is not responsible for any work performed by businesses listed on our platform. We provide the platform for businesses to be found by potential customers, but we do not intervene in the service or business transactions. Any issues or disputes relating to the services rendered must be taken up directly with the business.

  • No Endorsement: While we strive to maintain a reliable platform, we do not endorse, recommend, or guarantee the services of any business listed on Trade Page. Your decision to engage with any business listed on our platform is made at your own discretion and risk.


Trade Page Disclaimer for Businesses and Clients
 

Trade Page provides a platform for businesses to be listed online and promote their services. Businesses pay to be listed on our platform to enhance their visibility and connect with potential customers. However, we do not verify or guarantee the qualifications, skills, or experience of individual Tradies, Mechanics, or other Professionals listed on our platform.
 

It is important that you:
 

  • Check Qualifications: Ensure that the Tradie, Mechanic, or Professional you choose has the appropriate skills, qualifications, and experience to perform the job you require. This may include checking for relevant certifications, licences, insurance, or industry affiliations.

  • Verify Experience: Confirm that the business or individual has experience in the specific service you need. This will help ensure that you receive quality work and that the work is completed in accordance with your expectations.

  • Conduct Your Own Due Diligence: Trade Page cannot assess the nature or scope of your specific job. It is your responsibility to ensure that the business you choose is suitable for the task and has the appropriate capabilities to complete the work.
     

Additionally, please note the following:
 

  • Independent Businesses: The businesses listed on Trade Page are independent of us. We do not partner with, employ, or contract the businesses featured on our platform, nor do we control the pricing of their services. Any pricing, terms, or agreements regarding the services provided by businesses are solely between the business and the customer.

  • Public Access: Trade Page is a free platform for the public to browse and view business listings. You (the public) are responsible for selecting the business that best suits your needs.

  • Responsibility for Work: The businesses listed on our platform are solely responsible for the quality of the work they perform. Trade Page does not take responsibility for any services provided by businesses, including the accuracy, quality, or safety of the work. If you choose a business listed on our platform, any issues with the service, including payment disputes, work quality, or job completion, should be addressed directly with the business contracted.
     

No Guarantee of Leads or First-Page Ranking
 

While Trade Page optimises business listings to help improve visibility, we do not guarantee the following:
 

  • Guaranteed Leads: Trade Page is an advertising platform that helps businesses get noticed by local consumers, but we cannot guarantee that businesses will receive leads or enquiries through our platform. The number of leads a business receives depends on many factors, including the consumer's search intent, competition, and demand for specific services in a given area.

  • First-Page Ranking: We do not guarantee that your business will appear on the first page of search results. While we optimise your business page to improve search engine visibility, the ranking of your page on search engines (such as Google) is influenced by many factors, including search algorithms, competition, the quality of your content, and the use of sponsored ads. These factors are outside of our control, and ranking can fluctuate over time based on changes in these variables.

  • Search Engine Factors: Your business’s ranking and visibility can be affected by various external factors, such as sponsored ads or changes in search engine algorithms. As a result, the positioning of your business page on search engine results pages (SERPs) cannot be guaranteed by Trade Page.
     

Payment, Cancellation and Refund Terms

  • Pricing: The fees for our services will be communicated to you at the time of service selection. All prices are in Australian Dollars (AUD) and will be subject to GST.

  • Payment Method: Payments are processed through third-party payment gateways, and may be made via invoice or credit card. By using our services, you agree to comply with the terms and conditions of these third-party providers.

  • Refunds and Cancellations: By subscribing to Trade Page’s services, you agree to the terms listed below regarding cancellations and refunds.

  • Cancellation Policy: If you choose to cancel your membership or service before the end of the agreed term, you will be required to pay the full remaining membership fee for the remainder of your contracted term.  
    For example, if you cancel your membership after 6 months of a 12-month contract, you will be required to pay the remaining 6 months' worth of membership fees.
    The cancellation fee is non-negotiable and must be paid in full in order to terminate your agreement. This fee is necessary to compensate for the potential loss of business opportunities, such as the inability to offer the chosen suburb or location to another potential client, and any additional operational costs incurred due to managing your page.

  • Refunds: Trade Page does not offer refunds for services rendered, including the setup and management of your dedicated business page, unless required by law under the Australian Consumer Law.
    If you cancel your membership, you are not entitled to any refund for payments already made, except where required by applicable consumer laws.

  • Termination for Breach: In the event that Trade Page breaches the terms of service, you may be entitled to cancel your membership and request a refund for services that were not provided or delivered as promised.
    You must notify us of any breach in writing, and we will assess the situation in accordance with applicable laws.

  • Early Termination of Service: If you wish to terminate your service early for any reason, you agree to pay the full balance of the contract for the remaining term of the agreement.
    This cancellation fee reflects the cost of services provided, including the potential loss of business from not being able to accept a new client in your selected suburb or location, and any additional resources, such as staff, required to manage an increasing number of memberships.

  • No Refund for Marketing Results: Please note (as explained in “No Guarantee of Leads or First-Page Ranking”) that Trade Page does not guarantee specific marketing results, including lead generation or page ranking improvements. As such, no refund will be issued due to dissatisfaction with the marketing outcomes.

Content and Intellectual Property
 

  • Ownership of Content: As a user, you retain ownership of the content (e.g., logos, photos, videos, and other materials) you provide to us for the creation of your business page. By providing this content, you grant Trade Page a non-exclusive, worldwide, royalty-free license to use, display, and distribute the content for the purpose of creating and promoting your business page on our platform. Trade Page will create and design the content based on the information and materials you provide, and we will seek your approval before uploading the final content to your page.

  • Trade Page’s Content: All content created by Trade Page for your business landing page, including text, graphics, logos, images, and software developed by us, is owned by or licensed to Trade Page and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of Trade Page’s content without our prior written consent.
     

Ownership of Content
 

  • Limited License: Trade Page, as the owner of the copyright for this website, grants you a limited, non-exclusive, and revocable license to access, view, save, or print content from the website for personal use only, including for analysis or study.

  • Restrictions on Use: You may not reproduce, alter, copy, replicate, distribute, or create derivative works from any content on the website without the prior written consent of Trade Page. All content on the website, including but not limited to data, images, software, logos, text, and trademarks, is owned by or licensed to Trade Page and is protected under copyright, trademark, and other intellectual property laws unless explicitly stated otherwise.

  • Preservation of Content: You must ensure that all content remains intact and is presented as originally provided, without violating any intellectual property laws or the guidelines set forth by Trade Page.

  • Attribution: We reserve the right to include our company name, logo, and a hyperlink to our website in the footer of the landing page we create for you. This attribution is necessary to acknowledge our work and promote our business. We understand the importance of maintaining your brand’s consistency and will work with you to ensure that the placement of our attribution aligns with your website's design and messaging.

  • Prohibited Uses: By visiting our site, you agree not to use any information or content from our website for any purpose that is illegal under applicable law, prohibited by our Terms and Conditions, or that violates the rights of Trade Page.

  • Theme Protection: Our website theme is unique and protected by intellectual property rights. It may not be replicated or used on any other website without our explicit permission. Any unauthorised use or duplication of our theme will result in legal action.
     

Limitation of Liability
 

Trade Page provides its services on an "as-is" and "as-available" basis. While we strive to provide high-quality services, we make no warranties or representations regarding the accuracy, reliability, or availability of our services. To the maximum extent permitted by law, Trade Page is not responsible for:

Indemnity
 

You agree to indemnify, defend, and hold harmless Trade Page, its officers, employees, agents, and affiliates, from and against any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from your use of the website or services, including any content you submit, your violation of these Terms, or your violation of any law or third-party rights.
 

Dispute Resolution
 

In the event of any dispute arising out of or in connection with these Terms or your use of our services, you agree to resolve the dispute first through informal negotiations. If the dispute cannot be resolved informally, it will be referred to mediation in accordance with Australian laws. If mediation is unsuccessful, you agree that the dispute will be settled through arbitration or in a court of competent jurisdiction in Australia.
 

Governing Law
 

These Terms and Conditions will be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.
